1. About Us

These Terms and Conditions govern the use of www.newavonwildgame.co.uk (the "Website") and the sale of products by Newavon Wild Game ("we", "our", "us").

By accessing our Website and placing an order, you agree to be bound by these Terms and Conditions.

2. Definitions

Products means any venison, wild game, meat products, food products or other goods supplied by Newavon Wild Game.

Perishable Goods means products liable to deteriorate or expire rapidly.

Order means any order placed through the Website.

Business Day means Monday to Friday excluding public and bank holidays in England and Wales.

3. Eligibility

By placing an order, you confirm that:

• You are at least 18 years of age; and

• You are legally capable of entering into binding contracts.

4. Placing Orders

All orders placed through the Website constitute an offer to purchase Products.

Receipt of an order confirmation email does not constitute acceptance of your order. A contract shall only be formed once your order has been dispatched.

Newavon Wild Game reserves the right to refuse or cancel any order where:

• Products are unavailable;

• Payment authorisation has failed;

• Pricing errors have occurred;

• Delivery restrictions apply; or

• Fraudulent activity is suspected.

5. Product Information

Due to the wild and natural nature of our products, all product weights, sizes, colours, fat content and appearance are approximate and may vary from descriptions and photographs displayed on the Website.

As our products are derived from wild animals, despite every effort being taken during processing, products may occasionally contain small bone fragments, shot residue or other naturally occurring materials.

Product images are provided for illustrative purposes only.

6. Seasonal Availability

As our products are sourced from wild animals and seasonal supply chains, availability cannot always be guaranteed.

Newavon Wild Game reserves the right to substitute products of equivalent quality and value or issue refunds where products become unavailable.

7. Pricing

All prices shown on the Website are in Pounds Sterling (£) and include VAT where applicable.

Delivery charges are calculated separately and displayed during checkout.

We reserve the right to amend prices without prior notice.

8. Delivery

Newavon Wild Game currently delivers to mainland UK addresses unless otherwise agreed.

Orders are packed using insulated packaging and chilled or frozen packs to maintain product quality during transit.

Weekly Dispatch Schedule

Due to the perishable nature of our products, Newavon Wild Game operates a weekly dispatch schedule to ensure products do not remain within courier depots over weekends or remain in transit for extended periods.

To preserve product quality and maintain food safety standards, products supplied by Newavon Wild Game are not intended to remain within the courier network for more than 48 hours.

Orders must therefore be placed by 22:00 (10:00pm) every Wednesday to qualify for dispatch during the same week.

Orders received after this cut-off will automatically move to the following week's dispatch schedule and will not be collected by our courier until Monday morning.

Delivery dates and times are estimates only and cannot be guaranteed.

Newavon Wild Game reserves the right to delay or postpone dispatch where adverse weather, courier disruption or other circumstances may compromise product quality or food safety.

During periods of exceptionally high temperatures, severe weather or known courier disruption, dispatch may be postponed in order to protect the integrity of perishable products.

9. Failed Deliveries

Customers are responsible for ensuring that delivery details are accurate and complete.

Newavon Wild Game shall not be liable for failed deliveries, spoilage or additional charges resulting from:

• Incorrect delivery information;

• Failure to collect parcels;

• Failure to respond to courier communications; or

• Customer absence.

10. Safe Place Deliveries

Where customers request delivery to a designated safe place, neighbour or unattended location, delivery shall be deemed completed at that point.

Responsibility for the Products immediately passes to the customer upon delivery in accordance with those instructions.

Newavon Wild Game shall not be liable for theft, tampering, deterioration or temperature loss occurring thereafter.

11. Storage & Food Safety

Customers must refrigerate or freeze Products immediately upon receipt and in accordance with any storage instructions supplied.

Products may occasionally arrive chilled or partially thawed due to transportation conditions. Provided that Products remain cold to the touch and have been maintained within appropriate chilled temperatures during transit, they remain suitable for refrigeration and consumption.

Products that have remained suitably chilled upon arrival may also be suitable for refreezing. However, further freezing and thawing may affect product quality, texture and appearance. Customers should always follow current Food Standards Agency (FSA) guidance and any storage instructions supplied with the Products.

For food safety reasons, customers should inspect Products immediately upon delivery. Any Products that are warm to the touch, show signs of spoilage or are otherwise believed to be unsafe should not be consumed and should be reported to Newavon Wild Game within 24 hours of delivery.

Newavon Wild Game accepts no responsibility for deterioration in quality arising from improper storage following delivery.

12. Cancellations

Due to the perishable nature of our Products, orders for Perishable Goods are exempt from the statutory 14-day cancellation period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once dispatched.

Orders may only be cancelled prior to processing and dispatch.

13. Risk & Ownership

Risk in the Products passes to the customer upon delivery.

Ownership of the Products remains with Newavon Wild Game until payment has been received in full.

14. Limitation of Liability

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or any liability which cannot legally be excluded.

The total liability of Newavon Wild Game in connection with any order shall be limited to the purchase price of the Products concerned.

Newavon Wild Game shall not be liable for indirect losses, consequential losses, loss of profits or losses arising from delayed delivery or courier disruption.

15. Force Majeure

Newavon Wild Game shall not be liable for any delay or failure to perform obligations arising from circumstances beyond our reasonable control, including but not limited to:

• Severe weather;

• Flooding;

• Disease outbreaks;

• Supply shortages;

• Industrial action;

• Transport disruption;

• Government restrictions; or

• Failure of third-party courier services.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
